Declaration

The purpose of RainbowRing is simple: independent websites linking together to help visitors discover other independent websites, with a particular focus on the ZX Spectrum Next community.

By creating an account, submitting a website or participating as a RainbowRing member, you agree to these Terms.

Membership

Website owners may apply to add suitable websites to RainbowRing. Registration or submission of a website does not automatically make that website a live member of the ring.

Membership becomes active only after the required RainbowRing installation has been detected and the website has received final administrative approval.

RainbowRing may accept, decline, suspend, hide or remove a website where reasonably necessary to protect the service, its visitors or other members.

Your website and your responsibilities

You must have the authority to submit a website to RainbowRing.

You are responsible for the website you submit and for keeping the information supplied to RainbowRing reasonably accurate. You remain responsible for your website, its content, security, availability and compliance with applicable law.

Membership in RainbowRing does not transfer ownership of your website, branding or content to RainbowRing or Zingot Graphics.

RainbowRing installation

Participating websites must maintain a working RainbowRing installation appropriate to their platform.

This may be the standard RainbowRing widget, the RainbowRing WordPress plugin, or an approved Restricted Platform implementation where the hosting platform does not permit the standard widget.

RainbowRing may automatically check submitted websites to determine whether the required installation remains present and operational.

If an installation can no longer be detected, the website may temporarily disappear from public RainbowRing listings and navigation. Where an already approved installation becomes operational again, public visibility may be restored automatically without requiring the site's membership history to be discarded or final approval to be repeated.

Admin approval is persistent. Operational visibility is automatic.

Restricted Platforms

Some hosting services restrict JavaScript, embedded content or other functionality required by the standard RainbowRing widget. RainbowRing may provide an alternative Restricted Platform implementation for these sites.

Restricted Platform members must retain the required RainbowRing navigation links or assets in working form. Deliberately altering them so that they no longer perform their intended function may make the site ineligible for public participation.

Acceptable use

RainbowRing must not be used to distribute malware; conduct fraud or impersonation; deliberately mislead visitors about link destinations; interfere with RainbowRing or other member sites; abuse automated service interfaces; manipulate LUV, referrals, popularity or other service measurements; attempt to bypass membership, verification, moderation or security controls; or otherwise use the service unlawfully.

Attempts to manipulate or circumvent RainbowRing's technical or moderation systems may result in affected measurements being corrected or disregarded and, where appropriate, the relevant site or account being suspended or removed.

Content and moderation

RainbowRing does not claim ownership of content on member websites.

Member sites are independent websites operated by their respective owners. Inclusion in RainbowRing does not mean that Zingot Graphics endorses every statement, product, service or opinion appearing on those websites.

RainbowRing may refuse, hide, suspend or remove a website where its content, conduct or technical behaviour makes it unsuitable for the service, including where the site contains unlawful material, malicious content, deliberate abuse, deceptive behaviour, or material that creates a material risk to visitors or the operation of RainbowRing.

Where practical, moderation decisions may be reviewed following contact from the affected site owner, but inclusion in RainbowRing is not guaranteed.

Navigation

RainbowRing provides features intended to move visitors between participating websites, including Previous, Random and Next navigation.

Destinations may change as sites join, leave, become unavailable or change operational status. RainbowRing attempts to avoid directing visitors towards sites known to be unavailable, but cannot guarantee that every independently operated destination will be accessible or suitable at every moment.

LUV

LUV is a RainbowRing community feature allowing visitors to show appreciation for participating websites.

LUV is not a financial transaction and has no monetary value. Attempts to artificially manipulate LUV or related measurements may result in those measurements being corrected or disregarded and, where appropriate, membership being suspended or removed.

External websites

RainbowRing links to independently operated third-party websites. Zingot Graphics does not control those websites and is not responsible for their availability, security, privacy practices, accuracy or content.

Visitors should use the same judgement and precautions when following RainbowRing links as they would when following any other external link on the Internet.

Screenshots and site metadata

By submitting a website to RainbowRing, you permit RainbowRing to display the site's submitted information and reasonable visual or metadata representations of the publicly accessible website, including screenshots and favicons, for the purpose of operating, presenting and promoting the ring.

This permission does not transfer ownership of the underlying website or its content to RainbowRing. If a stored representation is materially inaccurate or inappropriate, the site owner may ask RainbowRing to review it.

Accounts and deletion

You are responsible for maintaining the security of your RainbowRing account credentials and should notify RainbowRing if you believe your account has been compromised.

A member may request removal of their sites or account. Removing a WordPress plugin, widget or Restricted Platform links does not by itself delete the corresponding RainbowRing account or stored membership record.

How account and site information is retained or deleted is described in the RainbowRing Privacy Policy.

Availability

RainbowRing is provided on a reasonable-efforts basis.

Although we aim to keep the service reliable, uninterrupted or error-free availability cannot be guaranteed. Maintenance, hosting failures, software faults, third-party failures, rate limits, network problems or circumstances outside our reasonable control may temporarily affect the service.

RainbowRing may also temporarily limit particular functions where reasonably necessary to protect the service, investigate abuse or respond to technical problems.

Changes to the service

RainbowRing may be updated, modified or improved over time. Features may be added, changed or removed where reasonably necessary for operation, security or development of the service.

Changes that materially affect members may also require these Terms or the Privacy Policy to be updated.

Suspension and termination

A website or account may be suspended or removed if it no longer meets membership requirements; its RainbowRing installation is deliberately removed or manipulated; it presents a security or abuse risk; its owner seriously or repeatedly breaches these Terms; or continued inclusion would reasonably harm RainbowRing, its visitors or its members.

Temporary operational failure does not necessarily mean permanent removal. RainbowRing may retain the membership record of an approved site while hiding it from public navigation until operation is restored.

Where an account or site is removed, information may still be retained where reasonably necessary for security, abuse investigation, legal claims or lawful obligations, as described in the Privacy Policy.

Intellectual property

RainbowRing's name, branding, software and original service materials remain the property of their respective owners. Member website owners retain their rights in their own websites, branding and content.

Permission to use RainbowRing assets is granted only as reasonably necessary to participate in or identify the RainbowRing service and does not transfer ownership of those assets.

Liability

RainbowRing is a discovery and navigation service between independently operated websites.

To the extent permitted by applicable law, Zingot Graphics is not responsible for loss or damage caused by the content, conduct, availability or security of independently operated member websites, or by temporary interruption or unavailability of RainbowRing.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, and nothing in these Terms affects statutory rights that cannot lawfully be excluded.

Privacy

The way RainbowRing processes personal and operational information is described in the RainbowRing Privacy Policy.

Changes to these Terms

These Terms may be updated as RainbowRing develops. The current version will be published on the RainbowRing website together with its revision date.

Where a change materially affects participating members, reasonable steps will be taken to make that change clear. Continued participation after revised Terms take effect may be subject to the updated Terms.

Governing law

These Terms are governed by the laws applicable in England and Wales, subject to any mandatory rights or protections that apply to you under the law of your place of residence.
